The Fonder website (hereinafter, “we” or “our”) is owned by Fonder LLC, located at 8 The Green, Dover, DE 19901, USA, which acts as the data controller of your personal data. We have adopted this Privacy Policy, which describes how we process the information collected through our platform and the reasons why we need to collect certain personal data about you. Please read this Privacy Policy before using our website or services. We are committed to protecting and ensuring the confidentiality and security of your personal data.
1. Who we are and scope
Fonder LLC, a Delaware, U.S. company (“Fonder”, “we”), operates the Fonder platform (www.fonderlatam.com). This Policy describes how we process personal data when the Client and its Authorized Users use the Service. If you do not agree, you must not use the Platform.
2. Controller/Processor and legal bases
Role: Fonder acts as a “processor” with respect to Client Data, and as a “controller” with respect to operational and contact data necessary for administration of the Service. Legal bases (by country): performance of the contract; compliance with legal obligations; legitimate interest in operating and improving the Service; and consent where required by law.
3. Data we process
a) Account and contact data: legal name, tax ID, emails, phone numbers, users. b) Financial/accounting/banking data: balances, transactions, receipts, DTE/DTEs/SAT, invoices, reconciliations, projections. c) Technical data: IP address, device identifiers, logs, usage events, settings. d) Integration credentials (read-only) stored encrypted.
4. Purposes of processing
• Provide the Service (consolidation, reconciliation, reports, projections, and alerts). • Support, billing, fraud prevention, and security. • Product improvement and development (usage metrics, controlled testing). • Permitted operational and commercial communications.
5. Anonymization, aggregation, and risk models
The Client authorizes Fonder to anonymize and aggregate data to create sector metrics, develop scoring/risk models, and negotiate/improve agreements with regulated financial institutions, without identifying natural or legal persons. The resulting datasets do not constitute personal data.
6. Integrations and banking secrecy
The Client authorizes read-only integrations with banks, ERPs, and tax authorities (AFIP/AR, SII/CL, SAT/MX, etc.). In Chile, such authorization is granted pursuant to Art. 154 of the LGB. Fonder does not execute orders or bank transactions.
7. International transfers
Data may be hosted in or accessed from the U.S. or other countries by Affiliates or sub-processors, under agreements that provide an equivalent level of protection and appropriate security measures. We remain responsible to the Client for our sub-processors.
8. Sub-processors and third parties
We use cloud, analytics, and support providers as sub-processors. We will keep an updated list available. We share data with third parties only when necessary to provide the Service, comply with the law, or with your authorization.
9. Data retention
We retain data for as long as the contractual relationship lasts and for additional reasonable periods to comply with legal obligations, resolve disputes, and enforce agreements. After that, we delete or anonymize it according to our retention policy.
10. Security
We apply encryption in transit and at rest, access controls, environment segregation, audit logs, and periodic testing and reviews. No method is foolproof; we will notify security incidents in accordance with applicable law.
11. Data subject rights (ARCO)
You may request access, rectification, updating, portability, objection, or deletion when applicable. To exercise these rights, write to us at somos@fonderlatam.com. We may require identity verification and impose limitations where permitted by law.
12. Commercial communications
We may send communications about the Service. Recipients may opt out at any time using the provided mechanisms or by writing to somos@fonderlatam.com. Operational and security communications do not allow opt-out.
13. Cookies and similar technologies
We use essential cookies to operate the Platform and optional cookies (analytics or functional) where required by law, with prior consent. Users can manage their preferences in the cookie banner. Details are available in our Cookie Policy.
14. Children and sensitive data
The Service is not directed to minors and does not intentionally process special categories of data. If you believe we are processing improper information, contact us for its deletion.
15. Updates to this Policy
We may update this Policy to reflect regulatory changes or changes to the Service. We will publish the current version and inform you of material changes within a reasonable time in advance.
